FREQUENTLY ASKED QUESTIONS ABOUT THE MARYLAND AUTISM WAIVER

  1. I am interested in the Autism Waiver Program. How do I get information and register for this program?
    Families interested in applying for the Autism Waiver Program should call 1-866-417-3480 to speak with someone regarding program information and registration.

  2. How can the waiver be closed?
    Since this is a medical assistance program, the federal government is allowed to put a "cap" on the number of participants. A wait list is being maintained by the Autism Waiver program.

  3. Is there a way to appeal if my child is deemed ineligible?
    The fair hearing appeals process is through DHMH under Title XIX and not through the MSDE/Individuals with Disabilities Education Act (IDEA) appeals process. Applicants who wish to appeal a denial of eligibility for waiver services may request a fair hearing at any time within 10 days from the date the notice of action was mailed.

  4. If a child is receiving intensive behavior management through the Developmental Disabilities Administration (DDA), is he eligible to receive waiver services?
    This depends on the funding of the child's DDA services. The child cannot be enrolled on the Developmental Disabilities (DD) Waiver and also be on the Autism Waiver. If DDA is providing non-waiver services, it is possible that the child could also be on the Autism Waiver.

  5. Can my child apply for the waiver if he already has health insurance?
    Yes.

  6. My child is not currently enrolled in a Baltimore County school. Is he still able to apply for the waiver?
    No. An IEP must have been developed for the child through the public school system.

  7. Will the waiver be in effect through the summer months?
    Yes, the waiver is a 12-month program.

  8. Is the school system responsible for providing the waiver services?
    No. The waiver program is primarily to support the family in the home and is not an entitlement under the Individuals with Disabilities Education Act (IDEA). State approved waiver providers are available to service eligible children.

  9. Can a family member outside the home or a family friend provide respite care?
    Yes, if the individual is working under the guidance of an approved Autism Waiver provider.

  10. Why is MSDE managing the Autism Waiver?
    Since families are already involved with local early intervention programs and special education programs, it was believed that it would make the process easier for them.

  11. Can a family choose the location of the service?
    A Plan of Care is developed to reflect the needs of the child. Services are accessed in the environment where specific waiver goals and objectives can be addressed.
