Family and Medical Leave Act (FMLA)
The Family Medical Leave Act (FMLA) was passed by Congress to protect employees who cannot attend work for reasons related to birth, adoption, or serious health conditions. Employees must be employed by the company for at least 12 months, working at least 1,250 hours within that time period to be eligible. The limit is 12 weeks per year. Baltimore County Public Schools will measure the 12 month period backwards from the date an employee uses any FMLA leave.

Employees who are eligible and are in need of FMLA leave must complete a FMLA application which can be obtained from their school or site administration office. This application must be completed within 30 days for any foreseeable need.

In accordance with the law, Baltimore County Public Schools will grant eligible employees up to a total of 12 workweeks of unpaid leave in a 12 month period for one or more of the following reasons:

  • The birth of a child.
  • To care for a newborn child.
  • The placement with the employee of a child for adoption or foster care, and to care for the newly placed child.
  • To care for an immediate family member with a serious health condition.
  • When the employee is unable to work because of a serious health condition.

If approved based upon BCPS policies and procedures, an employee may use his/her accrued paid leave in lieu of unpaid leave. Baltimore County Public Schools will maintain group health insurance coverage, including family coverage, for an employee on FMLA leave on the same terms as if the employee continued to work.
